Online Payments Terms & Conditions

The Conn Appliances, Inc. ("Conn's") Remote Payments Online Service (the "Service") is an optional alternative means of making payments or viewing your billing and payment history on your Conn's installment contract or retail charge agreement ("your account"). To enroll in the Service, you are required to complete the online enrollment forms with accurate information as prompted by the applicable enrollment form provided on the enrollment screen. If your customer profile, financial institution checking or savings account ("bank account" or "bank account information"), or credit card or debit card information ("card information") changes after you have enrolled, it is your responsibility to update your customer profile, bank account information or card information, as applicable, to ensure their accuracy, and you agree to do so promptly. Conn's will not be responsible or liable for relying on any inaccurate or incomplete customer profile, bank account information or card information that causes a payment to be rejected, returned, missed or paid late on your account.

Conn's Customer Service Department cannot change your online customer profile, bank account information or card information, but if you need assistance with the online enrollment forms, method for making payment, or any other questions concerning the Service, please call the Customer Service Department at 1 (877) 358-1252.

Once you complete the enrollment process and authorize a payment on your account, you are authorizing Conn's to initiate either a one-time payment (using your bank account information or card information as you direct) or multiple recurring payments by electronic ACH debits to your designated bank account. If you schedule a one-time payment, Conn's will process the payment using your card information or, if you have selected payment by ACH debit, Conn's will initiate an ACH debit for the payment in the amount you authorize, and in either case you will then be responsible for initiating payments on your account in the future using the Service or by making payment though other means. If you schedule automatic recurring ACH debits, Conn's will initiate multiple recurring ACH debits in the amount and on the day of the month instructed until such time as your account is paid in full or you elect to revoke the authorization in the manner specified below.

The cut-off time for current day processing of payments is 7:30 PM Central time on a business day. If you initiate a payment after the cut-off time on a business day, or you initiate payment on a Saturday, Sunday, or a Banking Holiday, your payment will be processed the following business day. It is your responsibility to ensure that payments are timely made in accordance with the terms of your account to avoid a default and potential late fees.

When you initiate a payment using the Service, you are authorizing Conn's to display, and the online screen will display, your Payment Amount, Monthly Payment amount, Account Balance and Current Payoff amount. These amounts are effective as of midnight on the date indicated and do not include any future activity on your account. In the event Conn's has not uploaded the proper Payment Amount, Monthly Payment amount, Account Balance or Current Payoff Amount when you access the Service, Conn's will notify you of the proper amount if a payment is made in reliance on the disclosed amount and will make an adjustment accordingly. In the event you pay the quoted Current Payoff amount, but additional amounts are owed by you, you agree to pay the additional amount you owe upon notification.

Conn's reserves the right to suspend or discontinue the Service and the acceptance of online payments at any time for any reason without prior notice. Conn's will attempt to provide you with prior notice of suspension or termination of the Service, but will not be liable for any failure to do so. If the Service is suspended or discontinued, you agree to make timely payment on your account by other means. The Service also may be suspended temporarily for maintenance purposes.

Protection of your Personal Information, Card Information, and Bank Account Information

The enrollment process requires you to type specified personal information, bank account information and card information, as applicable, into online forms as prompted by online enrollment screens. You agree to maintain the confidentiality and security of all information required for the enrollment process, including your email address, Login ID, password, challenge question and answer, your account number, bank account information, card information, PIN, and all other security and access information provided in the forms to prevent unauthorized access to your account or use of the Service. We recommend that you memorize your Login ID and password and do not write it down. You agree not to give or make available such information to any individual you have not authorized to access your account.

You will be notified of any payments initiated under the Service by email at the email address you specify in your online customer profile. You agree that it is your responsibility to notify Conn's Customer Service Department at 1 (877) 358-1252 immediately if an email confirmation is not received or is in accurate. You also agree to check your bank account statements promptly after receipt to verify that any amounts debited or credited to your bank account have been paid or credited in the correct amount and on the correct date.

You promise that you have all necessary rights, power and authority to authorize any payment you initiate from your bank account or through your card information when you use the Service and that you will have sufficient funds in your bank account to ensure that any ACH payment is not rejected or returned unpaid because of lack of funds. Furthermore, you agree to be entirely responsible for any and all activities and payment transactions relating to your account and your bank account when you or anyone else you authorize uses the Service. You agree to notify Conn's immediately upon your discovery of any unauthorized use of your account, bank account or card information, or of any breach of security relating to your account, bank account, or card information, or if you believe the confidentiality of your password or any other security or personal information relating to your account, bank account or card information has been compromised in any way (for example, your password has been lost or stolen, someone has attempted to use the Service under your account number or card information without your consent, your account has been accessed by an unauthorized person, or someone you have not authorized has transferred money from your account or bank account without your permission).

In the event funds have been withdrawn from your bank account or charges are assessed against your credit card in a manner that you did not authorize, you agree to contact your bank promptly to inform your bank of the unauthorized payment or charge. Conn's is not responsible for notifying your bank. Your bank may provide some form of fraud protection if you promptly notify your bank of the unauthorized payment or charge. Conn's will not be responsible for any loss you may incur as a result of someone else misusing your personal information, bank account information or card information either with or without your permission.

You could be held liable for losses incurred by Conn's or another party if someone other than you uses your password. You may not use anyone else's account at any time without the permission of the rightful account owner or holder.

It is your responsibility to update any personal information, bank account information and card information, as applicable, that changes after the date you enroll in the Service and you agree to do so promptly. You agree that your failure to update your personal information, bank account information or card information in a timely manner could result in payments not being made as instructed, or being paid late. Conn's is not responsible for any payment processing failures, rejections, delays, errors, fees or charges incurred by you if you fail to provide accurate personal information, card information or bank account information in the online enrollment forms or you fail to timely update your online enrollment forms. You may change your online customer profile, bank account information and card information, as applicable, at any time when the Service is available, but only by accessing the Service customer profile online. Conn's Customer Service Department is not authorized to make these changes for you, but if you need assistance in editing your customer profile you may call the Customer Service Department at 1 (877) 358-1252.

Software/Browser Requirements

Conn's recommends that you access the Service using Internet Explorer 5.x or higher, running on Windows 98 or newer (Windows XP preferred).

Your browser must be configured to support, and you agree to use the Service with a configured browser that has, the following features:128-bit encryption, Secure Sockets Layer (SSL), Java & Java Script enabled, Cookies enabled Cascading Style Sheets enabled, Automatically Load Images enabled.

You agree that if you are able to access the Service using a browser that does not meet these minimum standards and features, then you understand that lower encryption standards may jeopardize the confidentiality and security of your payment instructions and information, and in such instance Conn's disclaims any and all responsibility for losses resulting from your use of the Service. Conn's may change these requirements from time to time.

Without limiting any other provision hereof, you will bear the sole liability and risk of any error or loss of data, information, transactions or other losses which may result from the failure of your computer or third party communications providers on which you may rely. Conn's shall have no liability to you for any damage or other loss, direct or consequential, which you may incur by reason of your access to the Service using your computer or someone else's computer. It is your responsibility to ensure that your computer or anyone else's computer you use to access the Service has appropriate and updated firewalls and anti-virus programs installed.

Optional Processing Fees paid to Third-Parties:

You understand that you may be presented with the opportunity to make a remote, one-time electronic payment via credit or debit card utilizing the remote payment services by an independent third-party processor. If you choose to make such a remote, one-time electronic payment via credit or debit card, you understand that the payment processor may charge you a non-refundable processing fee not to exceed $2.25 per transaction in order to process such payment, and that Conn’s does not charge, collect, or retain any portion of such fee. You understand that payment of the third-party processing fee is not required in order to obtain financing from Conn’s or to repay your account, and that you have the option to make a payment on your account without paying the third-party processing fee by enrolling in automatic payments, making a payment in store, or paying by cash, check, or ACH.

Fee for Returned ACH Debits:

In the event your bank returns an attempted electronic ACH debit as unpaid, Conn's may reinitiate the ACH debit up to two additional times. If after these resubmissions the payment is not received by Conn's, you agree to pay a fee for the returned ACH debit in an amount equal to the lesser of (a) the amount allowed by the state governing law for your account, or (b) the amount set forth below based on the state governing law for your account, together with other amounts you may owe under your account:

In addition to the above fee, you may be charged a separate fee by your bank in the event your attempted ACH payment is returned to us unpaid. You agree to be responsible for payment of all bank fees incurred by your bank with respect to your bank account.

Late Fees

If you make a late payment on your account, you agree to pay the same late fee required by your account that you would be required to pay on a mailed or delivered payment that is received by Conn's after the scheduled due date.

Additional Terms for Multiple Recurring ACH Payments:

The Service allows you the option to set up automatic recurring payments on your account in a fixed amount on a specified day of each month. By activating the multiple automatic recurring payment feature, you are authorizing Conn's to initiate ACH debits, and if necessary, ACH credits or correction entries, to your bank account at the financial institution you have identified on your online enrollment form, on the day of the month specified and in the amount specified. Payment processing is handled by the bank account number you insert on the enrollment form, therefore it is critical that you insert the correct bank account number that you are prompted to insert on the enrollment form.

If you close or change your designated bank account for any reason, you are responsible for changing your customer profile in a timely manner to avoid future electronic ACH debits against your closed or changed account, late fees, and missed payments on your account. If an attempted electronic ACH debit is made against your closed or changed bank account and the payment is returned because you failed to edit your customer profile to reflect the new bank account information in a timely manner, you agree to pay the returned ACH debit fee set forth above in addition to any unpaid amounts due under your account and any charges assessed by your bank. Returned payments under certain circumstances may cause the recurring payment feature to be suspended. To ensure that Conn's has the opportunity to act upon any changes to your bank account information, your customer profile should be revised no later than three (3) business days prior to the date the first electronic ACH debit payment will be made against your new or changed bank account.

Revocation and Termination for Multiple Automatic ACH Payments:

Your authorization for recurring automatic ACH payments on your account will remain in full force and effect until the earlier of (a) the date when all amounts payable to Conn's under your account are paid in full or (b) no earlier than three (3) business days after the date you edit your online Service customer profile to revoke and terminate your authorization for subsequent ACH debits. You may terminate or revoke online ACH debit payments on your account at any time, but only by editing your online customer profile. You may not terminate or revoke your authorization in any other manner. Conn's Customer Service Department does not have the ability or authority to revoke or terminate your online authorization for multiple recurring ACH payments after you have enrolled in the Service, but if you need assistance in terminating or revoking your authorization you may call the Customer Service Department 1 (877) 358-1252.

If you terminate or revoke your recurring ACH payment authorization, you understand and agree that you will continue to be obligated to make all payments that remain to be paid under your account and will make those payments by other payment methods in the amounts and on the dates required by your account on or before the scheduled due dates as disclosed in your account agreement.

Expediting Fee:

Conn’s will not charge an expediting fee for payments you have initiated or a payment you authorized a Conn’s agent to initiate on your behalf using this Service.

Other Terms and Conditions:

To use the Service, it is your responsibility to ensure that you have the proper computer equipment and online capability to access the Service. You agree to be responsible for all on-line service charges imposed by your Internet service provider.

You agree to maintain balances in your bank account sufficient to pay all requested online payments on each payment date, and agree that Conn's is not liable for any overdraft, over-the-limit fees or insufficient funds or charges imposed by your bank which result from your attempt to make a payment using the Service or are caused by your failure to maintain funds in your bank account sufficient to pay any requested payments initiated through the Service.

Conn's reserves the right, under certain circumstances, to deny your access to your account or to the Service or any part thereof, or to deny the processing of payments, in order to maintain or restore security or performance of the Service. We may do so if we reasonably believe your password or other security access information has been or may be obtained or is being used or may be used by an unauthorized person(s).

You agree that all payments you initiate using the Service will be subject to and will comply with all applicable laws.

Your use of the Service does not give you any legal right or interest in the Service or in any of Conn's intellectual property used in connection with the Service or derived there from or any text or other content posted in connection therewith, including without limitation any trademarks, patents, or copyrights, for which all rights are reserved by Conn's.

Use of the Service is at your sole risk. Although Conn's has endeavored to create a secure and reliable website for making online payments, the confidentiality or security of any communication transmitted or accessible over the Internet cannot be guaranteed. Conn's encrypts your personal information on our systems and in transmission and complies with all applicable laws in handling such information. Accordingly, Conn's and its affiliates are not responsible for the security of any information transmitted or accessed using the Internet. Actual or attempted unauthorized use of this Service may result in criminal and/or civil prosecution.

Conn's use of your personal information will be in accordance with Conn's privacy statement which may be viewed at www.conns.com.

Conn's shall not be deemed to have waived any of its rights or remedies hereunder or as set forth in your account agreements unless such waiver is in writing and signed by Conn's. No delay or omission on the part of Conn's in exercising any rights or remedies shall operate as a waiver of such rights or remedies or any other rights or remedies. A waiver on any one occasion shall not be construed as a bar or wavier of any rights or remedies on future occasions.

Neither Conn's nor any of its affiliates, officers, directors, employees or agents, nor any other party involved in creating, producing, or delivering the Service, is liable for any direct, incidental, consequential, indirect, punitive, or other damages of any kind arising out of your access to or use of the Service, or your inability to access or use the Service, whether caused by Conn's or such other parties, online service providers, any agent or subcontractor of any of the foregoing or any other party.

WHILE CONN'S WILL ENDEAVOR TO PROVIDE ACCURATE INFORMATION IN CONNECTION WITH THE SERVICE, EXCEPT AS OTHERWISE EXPRESSLY PROVIDED HEREIN, CONN'S MAKES NO WARRANTY THAT (i) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR (ii) ANY INFORMATION CONTAINED ON, RESULTS THAT MAY BE OBTAINED FROM THE USE OF, OR OTHER ASPECT OF THE SERVICE WILL BE ACCURATE, CURRENT, COMPLETE OR RELIABLE.

Amendments to Terms and Conditions:

Conn's reserves the right to change the Terms and Conditions of the Service at any time by posting any revisions on this website. You are responsible for regularly reviewing the Terms and Conditions and any updates. Your continued use of the Service constitutes your agreement to all such Terms and Conditions and any posted amendments. You agree that Conn's shall not be liable to you or to any third party for any modification, suspension or discontinuance of this Service.

In the event you have any questions, need assistance in navigating the Service online, or desire updated payoff information, please contact Conn's Customer Service Department at 1 (877) 358-1252. CONN'S WILL SEND AN EMAIL CONFIRMATION OF ANY ONLINE PAYMENTS YOU MAKE THROUGH THE SERVICE, BUT CONN'S WILL NOT ASK YOU TO SEND ANY PERSONAL OR CONFIDENTIAL INFORMATION TO CONN'S USING EMAIL. DO NOT SEND ANY PERSONAL INFORMATION, BANK ACCOUNT INFORMATION, CARD INFORMATION OR ANY OTHER CONFIDENTIAL INFORMATION TO CONN'S BY EMAIL. If you receive an email that purports to come from Conn's, and the email asks for your personal information, card information or bank account information, do not respond to the email or click on any links in the email. Instead, immediately report the email to Conn's Customer Service Department at the above phone number.

Governing Law:

The Service and any dispute resulting from your use of the Service, shall be governed by and resolved in accordance with the laws of the State of Texas without reference to its principles on conflicts of laws.

Notwithstanding anything to the contrary in these Terms and Conditions, it is the mutual intent of you and Conn's to comply with all applicable laws. In each and every instance, Conn's rights are limited by applicable law (to the extent they may not be lawfully waived) and construed so as to comply with applicable law, and Conn's rights may not be exercised except to the extent permitted by applicable law. If any provision of these Terms and Conditions is void or unenforceable under any applicable law with respect to a jurisdiction, such ineffectiveness or unenforceability shall not affect the validity or enforceability of such provision in another jurisdiction or any other provision in that or any other jurisdiction.

These Terms and Conditions are binding upon you and your heirs, executors, and personal representatives, and insure to the benefit of Conn's and its successors and assigns.

There are no oral agreements relating to your use of this Service. No person associated with Conn's is authorized to modify or waive these Terms and Conditions orally.

By using the Service and Conn's website for any payment, transaction or service, you agree that you have read and understood the foregoing Terms and Conditions and agree to be bound by these Terms and Conditions and any future amendments.
